About these terms

These Terms of Use ("Terms") apply to the Kinwatch iOS application (the "App") and the kinwatch.net website. By installing, signing in to, or using Kinwatch, you agree to these Terms.

These Terms are between you and me, Michael Raab, an individual developer (referred to as "I", "me", "my", or "Kinwatch" throughout this document). If you do not agree with these Terms, please do not use the App.

Apple's standard EULA

Kinwatch is distributed through the Apple App Store. Your use of the App is also governed by Apple's standard Licensed Application End-User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula.

Apple is a third-party beneficiary of these Terms and of Apple's standard EULA. Apple has the right (but not the obligation) to enforce these Terms against you. Apple is not a party to these Terms and is not responsible for the App or its content.

Who may use Kinwatch

To use Kinwatch, you must:

Kinwatch is intended for use by adults who are caregivers. If you are caring for a minor, you (the adult caregiver) are the user of the App. The minor does not use the App directly.

Where Kinwatch is available

Kinwatch is sold through the App Store in selected English-speaking countries outside the European Union (currently the United States, United Kingdom, Canada, Australia, and New Zealand). It is not available for download in other regions. Available regions may change over time; the App Store listing reflects the current list.

Subscription

Kinwatch is offered as a single auto-renewing subscription. The subscription details are:

5.1 Free trial

New subscribers receive a 7-day free trial. You will not be charged during the trial. If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription at the price above. Only one free trial is available per Apple Account.

5.2 Auto-renewal

Your subscription renews automatically at the end of each billing period unless you cancel it at least 24 hours before the renewal date. The renewal charge is applied to the payment method on file with your Apple Account, typically within 24 hours of the end of the current period.

5.3 How to cancel

You can cancel your subscription at any time through your Apple Account. Cancellation stops future renewals; your subscription remains active until the end of the current paid period.

5.4 Family members

A Kinwatch subscription lets you invite up to 5 family members to share a care recipient's information through iCloud sharing. Invited family members do not need their own subscription to view the shared data. You can add or remove family members at any time from inside the App.

If you cancel your subscription or it otherwise lapses, invited family members will lose editing access, but the data remains in your iCloud account and becomes accessible again if you resume the subscription.

5.5 Refunds

Apple handles all refunds for subscriptions purchased through the App Store. I do not issue refunds directly. To request a refund, use Apple's refund process at reportaproblem.apple.com. Apple's refund decisions are final.

5.6 Price changes

I may change the subscription price in the future. If the price increases for existing subscribers, Apple will notify you and, where required by regional law, ask you to explicitly consent to the new price. If you do not consent, your subscription will not auto-renew at the new price.

Your data and content

All information you enter into Kinwatch (medications, care providers, notes, documents, and everything else) is your data. You own it. Kinwatch does not acquire any rights to it.

Your data is stored in your own iCloud account, encrypted end-to-end, as described in the Privacy Policy. I cannot see your data and do not process it on any server. If your subscription ends, your data remains in your iCloud account until you choose to delete it.

License to use the App

Subject to these Terms, Apple's standard EULA, and your active subscription, you have a non-exclusive, non-transferable license to use the App on Apple-branded devices that you own or control, for your personal, non-commercial use. This license does not allow you to:

Kinwatch is not medical advice

Kinwatch is an information-organization tool, not a medical device. It does not diagnose conditions, recommend treatments, calculate dosages, or provide medical advice of any kind. It does not monitor physiological signals or detect emergencies.

Always consult a qualified healthcare professional for medical decisions. The accuracy of the information in Kinwatch depends entirely on what you enter. You are responsible for verifying that medications, dosages, allergies, and other critical information are correct. Print-outs generated by the App are summaries of what you have entered, not medical records issued by a healthcare provider.

In a medical emergency, call your local emergency services. Do not rely on Kinwatch as a substitute for emergency communication.

Disclaimer of warranties

The App is provided "as is" and "as available", without warranty of any kind, express or implied, to the fullest extent permitted by applicable law. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, or accuracy.

I do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components; that defects will be corrected; or that the App, your iCloud data, or the servers that make the App available are free from any harmful elements. You use the App at your own discretion and risk.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by applicable law, in no event shall Michael Raab, Kinwatch, or Apple be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, loss of data, loss of goodwill, service interruption, device failure, medical consequences, or any other damages arising out of or in connection with your use of, or inability to use, the App.

My total aggregate liability to you for all claims arising out of or relating to these Terms or the App, whether in contract, tort, or otherwise, shall not exceed the greater of (a) the amount you paid to Apple for the App during the 12 months preceding the claim, or (b) US $100.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Michael Raab and Kinwatch from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your violation of these Terms; (b) your misuse of the App; (c) your violation of any law or the rights of any third party; or (d) information you enter into the App about another person without their consent or without legal authority to do so.

Accuracy of information you enter

Kinwatch stores the information you enter and displays it back to you. I do not validate it against medical records, pharmacy databases, or any other source. If you enter an incorrect medication name, dosage, allergy, or other detail, Kinwatch will faithfully store that incorrect information.

You are responsible for keeping the information in Kinwatch accurate and up to date. Review what you have entered before relying on it in a medical setting.

Third-party services

Kinwatch uses Apple services (the App Store, iCloud, CloudKit, StoreKit, MapKit, EventKit). Your use of those services is governed by Apple's own terms and privacy practices, available at apple.com/legal.

The one-tap "Directions" feature opens Apple Maps. The one-tap "Call" feature opens your device's phone dialler. Your use of those features is subject to the terms of your device and your mobile carrier.

Kinwatch does not include other third-party services, analytics, advertising networks, or data brokers.

Changes to the App

I may add, change, or remove features at any time. For significant changes, I will update the App Store listing. In rare cases where I need to remove a feature that affects your stored data, I will give you advance notice through the App or by email (if you have opted in) so you can export your data before the change takes effect.

If I discontinue Kinwatch entirely, I will give you at least 90 days' notice, during which the App will continue to work and you can export your data. Your data in your iCloud account is not affected by changes to the App.

Termination

You may stop using Kinwatch at any time by cancelling your subscription (Section 5.3) and removing the App from your devices. Your data in your iCloud account remains yours.

I may suspend or terminate your access to the App if you materially breach these Terms, including Section 8 (Acceptable use) or Section 9 (not using Kinwatch as medical advice). Apple may also remove the App from the App Store at its own discretion. Sections 6 (your data), 9 (not medical advice), 10 (disclaimer), 11 (limitation of liability), 12 (indemnification), and 18 (governing law) survive termination.

Changes to these Terms

I may update these Terms from time to time. If changes are material, I will:

Your continued use of the App after material changes take effect constitutes acceptance of the updated Terms. If you do not accept the updated Terms, your only remedy is to cancel your subscription and stop using the App.

Governing law and disputes

These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-laws principles. This choice of law does not deprive you of any protection afforded by mandatory provisions of the consumer protection law of the country where you reside.

Before filing a formal claim, you agree to attempt to resolve the dispute informally by contacting me at contact@kinwatch.net. If we cannot resolve the dispute within 60 days, either of us may pursue the claim through the courts with jurisdiction in Bangkok, Thailand, subject to any mandatory right you have to bring proceedings in the courts of your country of residence.
